What should I do after my first speeding ticket in NY?
I live in Upstate New York and am a 19 year old male. I am under my parent’s insurance policy. I received a speeding ticket for going 68 in a 45. There are two options: plead guilty or not guilty. I did state to the officer that I was “maybe pushing 10 or 15 over.” Stupid, I know. So I guess my only option is to plead guilty. Will I just be sent a bill in the mail? Do I still have to attend the court date listed on the ticket? I’ve read that insurance companies usually do not raise rates after the first ticket. But will they with me because I am so young? How much of an increase is typical? I also heard that a letter will be sent to my parents stating that I have committed a traffic infraction, but I’m over 18. Is this true? Thanks for the help.
I never heard of a letter being sent to your parents – someone is pulling your leg on that one.
You have a right to fight the ticket, yours is not an argument of whether or not you were speeding, and you admitted that you were, yours is a question of how fast.
Again, if you plead guilty and make that statement, which even if you don’t the officer will refer back to his notes and relinquishes any conversation at the stop during testimony. Of you can follow the directions on the summons with payment and surcharge information. You have a certain amount of time (it may have changed in the last few years), if you do not get the payment or plea in – you will be suspended.
Edit: Someone states here that 23 over is a Misd. in NY – They are wrong. 30 MPH over is a must appear. There is also a difference between VTL Misd. and PL Misd. This is where YA needs to be watched. A Misd. is a crime, true. It is also an arrest. This is a violation not a crime! Refer to 1180 (d) of the NYS VTL.
