in illinois child-support is support to stop at 18. mine stopped and the reinstated at 21 please help.?

no payment were collected in the 2yr gap, from the date child-support stopped (2-2003)till the date of the new court order(3-2005) now the state wants me to pay back child-support plus interest. my daugther was still in high school. so they contend if should of kept paying while she was still in school(my dauther graduated 2005 at the age of 20… but the mother didnt file any motions to reinstate the court order until 3-2005. the best case i found states if a child is still in high school after the age of 18—the non costodial parent is obligated to pay till the age of 19???? is this true under Ill law????? Am I legally responsable to pay for anything after her 18th birthday the new court order in 3-2005 states that child support shall continue from march 2005 until child graduates in 6-2005, other wise original order remains in effect(stop on her 18th birthday) please help!!!!!! thank you wecho

It may depend a little on your original order. Some word it kind of fishy, such as “until 18, or the age of emanciation) wich is what mine says. So as long as my daughter is living in my house, and going to school, she still recieves child support. Ours was standard, and we have a verbal agreement outside of it, that I won’t expect it after 18, even though its legal, I don’t think its right.

Your ex may have just gotten lucky and got a judge who wanted to stick it to someone, and you got the raw end of the deal. Check with an attorney if you think it’s bogus. many initial consultations are free.
